Consultation on Proposals for offences and penalties and enforcement in relation to EC Regulation 842/2006 on Certain Fluorinate



 

  1. I am writing to invite views on proposed draft offences and penalties Regulations that carry forward the implementation of EC Regulation 842/2006 on Certain Fluorinated Greenhouse Gases.

2.      A separate consultation paper is being issued dealing with implementation issues relating to the 2006 Regulation No 2037/2000 on substances that deplete the ozone layer.  This can be found at http://www.defra.gov.uk/corporate/consult/ozone/index.htm The proposals in that paper affect some but not all of the sectors affected by this consultation paper, which is why separate consultation papers are being published.

3.      This consultation is available on the Defra website at: http://www.defra.gov.uk/corporate/consult/f-gas/index.htm

8.      In line with Defra’s policy of openness, at the end of the consultation period copies of the responses we receive will be made publicly available through the Defra Information Resource Centre, Lower Ground Floor, Ergon House, 17 Smith Square, London SW1P 3JR. The information they contain will also be published in a summary of responses.

9.      If you do not consent to this, you must clearly request that your response be treated confidentially.   Any confidentiality disclaimer generated by your IT system in e-mail responses will not be treated as such a request.   You should also be aware that there might be circumstances in which Defra will be required to communicate information to third parties on request, in order to comply with its obligations under the Freedom of Information Act 2000 and the Environmental Information Regulations.

The objectives of the F-GAS Regulation


The principal objective is to contain, prevent and thereby reduce emissions of f-gases covered by the Kyoto Protocol. This Regulation will make a significant contribution towards the European Community's Kyoto Protocol target by introducing cost-effective mitigation measures and to prevent distortion of the internal market. The main focus is on containment and recovery of f-gases, together with harmonised restrictions on the marketing and use of f-gases in applications where containment of f-gases is difficult to achieve or the use of f-gases is considered inappropriate and suitable alternatives exist.
